Madurai: Madras high court on Tuesday quashed the final report filed against two suspended sub-inspectors of police (SI), parents of Surjith, the main accused in the caste killing case of C Kavin Selva Ganesh, who was murdered in Tirunelveli district in 2025.The court was hearing the petitions filed by Saravanan, his wife Krishnakumari and Jayapal challenging the final report filed against them before the II additional district court (PCR Act Cases) in Tirunelveli.According to the final report, Saravanan and his wife Krishnakumari came to know of the relationship between their daughter S Subhashini and the deceased Ganesh during 2016-2017. While Saravanan cautioned his daughter and spoke to Ganesh over telephone, Krishnakumari contacted his mother and warned her.During the academic year 2018-2019, when her daughter was pursuing second year of the BSMS course, the petitioners once again contacted the mother of the deceased over phone and warned her.Justice R Vijayakumar observed that there is no eyewitness to the meeting. There is no CCTV footage, photograph, video recording or statement of any independent witness. There is no recording, transcript, message or any other electronic material disclosing what transpired between them. The meeting is sought to be established solely on the circumstance that the mobile phones attributed to all three people were connected to the same cell tower during the relevant period. It is the prosecution’s own case, as recorded in the final report, that Saravanan proceeded to the scene of occurrence within 16 minutes of receiving information from Surjith and spoke to the police there. It is also the prosecution’s case that he informed a head constable that the murder had been committed by his son.The foundational requirements for invoking the relevant sections under the SC/ST Act are absent, the judge observed and quashed the final report against Saravanan and Krishnakumari.The judge observed that the destruction of clothes, the removal of number plate and damaging of the cell phone are alleged to have taken place on premises owned and run by Jayapal. Whether the petitioner had an antecedent plan or was party to a conspiracy in the murder committed by A1 is a question that must abide by the trial and cannot be gone into at the stage of a quash petition. Hence, the judge dismissed the petition filed by Jayapal.Inset:In his X post, VCK leader Thol Thirumavalavan said that it is shocking that the Madras HC had quashed the final report against Saravanan and Krishnakumari. Quashing a final report even before the commencement of criminal trial sets a ‘wrong precedent.’ He said that Saravanan, who was released on bail, was arrested again for his alleged links to a gang of contract killers in yet another murder case. The HC’s order has created an impression that such an individual and his wife are innocent. On behalf of VCK, we strongly urge the state govt to prefer an appeal against this order.
