Mohali: The National Consumer Disputes Redressal Commission (NCDRC) has directed the Greater Mohali Area Development Authority (Gmada) to review the completion certificates issued for Purab Premium Apartments and issue fresh certificates within 30 days of receiving a certified copy of its order. The commission has asked the Gmada chief administrator to examine technical reports, verify whether all promised works and facilities have been completed, and establish the project’s actual completion date, putting the validity of certificates issued in Oct 2024 under scrutiny.Residents said the order is significant as the project’s completion date has a direct bearing on delay compensation and maintenance charges payable by allottees. The dispute traces back to the NCDRC’s May 4, 2023 judgment in consumer complaints related to the housing project. The commission had observed that Gmada, acting as both developer and competent authority, issued allotment letters in June 2016 without a valid occupation or completion certificate and subsequently directed it to obtain the requisite certificate within 45 days. The commission had further ruled that delay compensation at 6% simple interest would be payable only till June 2016 if the project was found complete by then. If completion occurred later, compensation would continue until the date established through a valid certificate. A clarification issued on Nov 7, 2023, applied the same principle to maintenance charges. On Oct 18, 2024, Gmada issued two completion certificates covering all 27 towers of the project. The Allottees Association challenged the certificates during execution proceedings, contending that questions remained over whether all promised works had been completed before their issuance. The residents’ welfare association also approached the commission seeking modification of the Nov 2023 clarification and impleadment in the proceedings.Box | Why Actual Completion Date MattersDetermines period for delay compensation payable to allotteesImpacts calculation of maintenance chargesLinked to NCDRC’s 2023 directions on project completionGmada now required to verify whether all promised works were finished before issuing certificatesFresh certificates to be issued after technical review and verification of works completed within the project
