GURGAON: Kalyan Singh Bainsla, accused of chasing and ramming a woman biker in Gurgaon was allegedly returning from a club with his friends when the incident took place, sources told TOI.Bainsla was driving the white Maruti Ciaz when it allegedly knocked down Delhi-based biker Shivani Chauhan near the Sector 55-56 Rapid Metro station on Sunday.His cousin Lavnish, who was sitting in the passenger seat, was also arrested and sent to police custody.According to sources, Lavnish allegedly instigated Bainsla to chase Chauhan and also allegedly abused her during the incident.Police have described the incident as a “murder bid” and formed a five-member special investigation team (SIT) to investigate the case. The team is headed by the ACP (crime and women) and includes the SHO of Sector 56 police station, the Sohna crime branch in charge and two other police officers.
Police recreate the alleged chase
A local court on Wednesday sent Bainsla and Lavnish to police custody until Friday. Investigators said they would take the two accused to the spot during their custody to recreate the sequence of events.Police said they needed the custodial remand to prepare a crime script, establish the movements of the accused and determine the role of others who may have been involved.Chauhan told police that the driver of the white Ciaz, registration number HR-30-Y-4949, made indecent gestures at her before chasing her and deliberately ramming her motorcycle.Footage recorded by her motorcycle’s camera shows the car repeatedly attempting to get alongside her Aprilia RS 457 before hitting it. The motorcycle then slid across the road as other vehicles continued to pass the scene.
Case upgraded after biker’s statement
The case was initially registered under sections 281 and 125 of the Bharatiya Nyaya Sanhita (BNS) against an unidentified driver.After Chauhan’s statement and examination of the footage, police added sections 78, 79 and 109(1) of the BNS. The charges include an attempt-to-murder provision.Police took suo motu cognisance of the incident after a video posted by the Instagram account ‘Rebelwheels_Sia’ went viral on September 14. The video showed the white Ciaz and Chauhan’s motorcycle.Chauhan later handed investigators a pen drive containing footage from her bike camera. Police also collected CCTV recordings from the GMDA and DLF covering Golf Course Road and the Metro station area between 6am and 8am on September 13.Investigators from the Sector 56 police station and Sohna crime branch searched for Bainsla at his Palwal residence and other locations before arresting him and Lavnish in Rajasthan on September 15. The white Ciaz was seized after the arrests.
Police look for others in the car
Chauhan has told police that four people were inside the car at the time of the incident.Police said Bainsla and Lavnish were aware of the whereabouts of the other two people and that teams were trying to trace them in Faridabad and Palwal.The investigation team is also expected to establish the sequence of events through the recreation at the spot and by examining the available CCTV and vehicle-camera footage.The accused’s lawyer, Lalit Bindal, opposed the request for police custody and argued that the case was one of rash and negligent driving rather than an attempt to murder.“Surprisingly, the accused were in the custody of the cops on Tuesday and thus they had sufficient time to investigate or interrogate them. It is just an accident case but police in order to arrest the accused have levelled sections pertaining to attempt to murder. It is a matter of rash and negligent driving and thus cops didn’t need his remand,” Bindal said.The two accused remain in police custody until Friday as investigators continue to examine the footage, reconstruct the incident and trace the other people allegedly present in the car.
