Why Justice Kaul said governments respect judges who respect themselves

Former Supreme Court judge Sanjay Kishan Kaul’s memoir questions D Y Chandrachud’s handling of appointments and sensitive cases and claims he was too “deferential” to the government

Former Supreme Court judge Sanjay Kishan Kaul says D Y Chandrachud gave the government too much say in choosing judges. “I believed he was too deferential to the government on appointment matters,” Kaul writes of the former Chief Justice of India in his book ‘Without Fear or Favour’.
Kaul served with Chandrachud on the collegium, the group of senior judges that recommends Supreme Court and High Court appointments. He accepts that the government must be consulted. His objection is to “pre-approval”. He defines it as “seeking the government’s nod before the collegium had even formally deliberated”.
